Definitions
In these Terms & Conditions (Terms), the following defined terms have the following meanings:
our, we, us and MIIRA means Aradena Pty Ltd (a company registered in Australia under the Corporations Act 2001 (Cth))trading as MIIRA.
Services means the services supplied by us in connection with the Website and our business generally.
Terms means these terms and conditions and include the Trip Information.
Trip means a trip offered and advertised for sale on our Website.
Trip Information means any information available to you via our Website pertaining to a specific Trip including but not limited to destinations, itinerary, inclusions and pricing.
Website means www.entermiira.com
you or your means the person or person(s) who have booked a Trip or who otherwise engage with us in relation to MIIRA.
Applicability
These Terms apply to all dealings between you and MIIRA, to the exclusion of any other Terms, and constitute a legally binding agreement between us which is governed by and subject to the exclusive jurisdiction of the laws in force in Western Australia from time to time. You irrevocably and unconditionally submit to the exclusive jurisdiction of the courts of Western Australia and all courts which have jurisdiction to hear appeals from those courts and waive any right to object to proceedings being brought in those courts for any reason.
By booking a Trip, you acknowledge and agree that:
(a) you have read and understood the Terms;
(b) where you book a Trip on behalf of a third party, that party has read and understood the Terms and you have all valid authority and consent to make the booking on their behalf;
(c) all information disclosed to us by you at any time is and will be truthful, complete, and shall not omit any information that ought reasonably to be disclosed to us, having regard to the nature of our business (including but not limited to particulars of medical, health or dietary conditions or disabilities);
(d) you have obtained all necessary medical advice in relation to your health, safety and suitability to attend the Trip and participate in the scheduled activities, and you will take all reasonable precautions both before and after the Trip to ensure you remain in good health and safety prior to attending the Trip.
Bookings
To secure a booking, you must pay the deposit stated in the Terms or make full payment if the booking is made within 100 days of the commencement of the Trip.
Payment may be made pursuant to payment options set out in an invoice issued to you. Your place will not be confirmed until such an invoice has been issued, and payment of the deposit (or if under 100 days, payment for the Trip in full) has been made. Please note that prices may vary depending on which currency the booking is made as a matter of currency conversion fluctuations.
Bookings made less than 100 days from commencement of a Trip may attract a surcharge if additional costs are incurred by MIIRA due to the late nature of the booking. A surcharge may also be payable on account of changes you may request to your booking (including room upgrades or requests to be accommodated with other guests). We will make every effort to avoid or minimise the occurrence of such costs, and will advise you of any applicable costs prior to your booking.
We reserve the right to decline any booking enquiry in our absolute discretion.
Transferring your booking
We will accommodate a request to transfer a booking to a third party provided:
(a) there are no outstanding payments in respect of the booking at the time of the request;
(b) the request is made no less than 30 days from the commencement date of the Trip;
(c) the proposed transferee has agreed to be bound by these Terms; and
(d) you or the proposed transferee make payment of the AUD $200 administrative fee on account of the transfer, together with any third party supplier costs we may incur as a result of the transfer.
Cancellations and Refunds
All cancellation requests must be made in writing. We offer a full refund if you change your mind within 48 hours of purchase, provided your trip does not commence within 100 days from the cancellation. Refunds will be processed to the original payment method within a reasonable timeframe. Bookings are otherwise non-refundable, due to the nature of our trips and limited spaces available. In addition to mandatory insurance (refer “Travel Insurance” below), we strongly recommended that comprehensive travel insurance is taken out at the time of booking to include full cover in respect of cancellations.
In the unlikely event MIIRA has to cancel a trip for any reason, you may choose to transfer your booking to any future trip in the same destination if available, alternatively we will issue a full refund. A refund will not be offered in circumstances where MIIRA may be required to make changes to any advertised itinerary, inclusions, accommodation, or experiences due to availability, weather, force majeure, or other circumstances beyond our control, where we are able to preserve the overall quality and value of the experience.
Promotions
From time to time, we may offer discounts, deals or promotional offers relating to Trips. These offers only apply to new bookings, and you accept that upon booking your place on a Trip you are obliged to pay the booking fee quoted on the invoice at the time of booking, irrespective of any offers that may be published by us after that time in relation to the same Trip. Promotions cannot be obtained in this way by transferring your booking to a third party, or by cancelling and rebooking.
Travel insurance
Each guest must take out at his/her own cost comprehensive travel insurance in respect of the full duration of the Trip, to cover (at least) medical expenses, injury, death, repatriation, cancellation and curtailment. You must provide us with a copy of your insurance cover at least 30 days prior to commencement of the Trip. Failure to obtain travel insurance may result in cancellation of your booking.
Provision of information
Prior to commencement of the Trip, we will ask you for certain information relating to yourself and any guests under your booking to ensure we are able to deliver our services to the high standard on which we operate. You must provide all requested information promptly and accurately, without omission of any information of which we ought reasonably to be apprised having regard to the nature of our business and the Trip you have booked. If you do not provide us with information in this way, and additional costs arise from arrangements we are requested or required to make to accommodate you, you agree to be responsible for those costs.
If you have any medical condition, disability or special requirements which may affect your participation in our Trip or which may foreseeably affect other participants in the Trip, please advise us prior to the time of booking so that we can assess the suitability of the Trip for you. You must also advise us of such condition, disability or circumstances occurring after the time of booking and before the commencement of the Trip. You agree to provide us with a medical clearance if requested, at your cost. If we, acting in our reasonable discretion, consider your condition is likely to adversely affect your participation in our Trip or that of other other participants in the Trip, we reserve the right to cancel your booking.
Nature of the Trip
MIIRA Trips are designed to offer a range of cultural, social, active and relaxation activities suitable for women unaffected by medical conditions or disability. We strongly recommend that you read the pre-departure information we supply to you to ensure that you understand the itinerary, style and any physical demands of the Trip you book. While MIIRA does not offer ‘adventure travel’ or high risk activities, you appreciate and accept the possible risks inherent in travel and in the scheduled itinerary disclosed which may include activities involving physical exertion, and agree to participate at your own risk and assume responsibility for your safety and wellbeing at all times. All Trip itineraries are subject to change due to unforeseen circumstances, including but not limited to weather, political unrest, and currency fluctuations, availability, and other circumstances outside our control.
Each Trip will include a minimum of 7 scheduled hours per day (Scheduled Hours), during which experiences and activities will take place. On ground transport to and from guest accommodation will be provided at the commencement and conclusion of each day’s Scheduled Hours. Should guests refuse transport or wish to make their own arrangements, they do so at their own risk. Guests are solely responsible for their actions and activities undertaken outside Scheduled Hours. MIIRA is not liable for any loss, damage, injury, or expense arising from independent activities, personal decisions, or conduct outside Scheduled Hours.
Any recommendations we may make for activities or experiences outside Scheduled Hours are general suggestions only, and are not endorsed by us with any degree of suitability or availability for you or any person in your party. They do not form part of our Trip, and as such fall outside the scope of our public liability insurance.
Consumption of food and drinks
All food and beverages served during Scheduled Hours are included in the Trip booking fee, as advertised in the Trip Information relating to your Trip. You are responsible for the purchase and consumption of any food and drinks you may consume outside of Scheduled Hours.
At the time of booking, you must inform MIIRA of any dietary requirements or allergies relating to any person in your booking, so that we can make the appropriate arrangements. Failure to disclose may result in inability to serve you, or reduced enjoyment of your experience on the whole. Please note MIIRA is not obliged to cater to lifestyle diet preferences. If we are requested or required to make arrangements to accommodate dietary requests not disclosed at the time of booking, or personal preferences, and these arrangements result in costs payable to our suppliers, you agree that you will be liable to reimburse MIIRA for these costs which will be notified to you.
MIIRA makes every effort to design a balanced and varied menu over the course of the Trip. In some instances, a menu will be offered including dining choices, but in other instances a set menu designed for the table will be offered.
Guests are required to exercise all due care in responsible enjoyment of alcoholic beverages. Guests are expected to drink in moderation, particularly in consideration of scheduled active days, heat, terrain, and safety. MIIRA reserves the right to limit or refuse the service of alcohol at any point in the Trip where we reasonably consider a guest’s consumption may pose a risk to themselves or others.
Conduct
MIIRA is built around creating a safe, respectful, and enjoyable environment for all guests, hosts, and local partners. Guests are expected to conduct themselves in a manner that does not endanger, inconvenience, or negatively impact others, including fellow guests, Trip hosts, service providers, or members of the local community.
This includes following the reasonable instructions of MIIRA hosts and local guides, complying with local laws and customs, and acting with consideration during all Scheduled Hours and independent activities outside Scheduled Hours. Use of illicit substances is expressly prohibited. Disruptive, unsafe, or inappropriate behaviour - including conduct that places a guest or others at risk (physical or psychosocial) - may result in a guest being restricted from certain experiences or, in serious cases, removed from the remainder of the Trip without refund. MIIRA reserves the right to take such action where it is reasonably necessary to protect the safety, comfort, and experience of the group.
You accept responsibility for any damage or loss caused by you or any third party under your booking, and you must make prompt payment for any such damage or loss as directed by MIIRA.
Communications and assistance
Prior to and during the Trip, our primary method of communication with you will be email and WhatsApp. Please ensure you have downloaded the latest version of WhatsApp to your mobile device and that you have an active data plan enabling you to send and receive messages and phone calls. You consent to your mobile number being added to a group chat with other Trip guests during the Trip, for the purposes of practical and timely communications, and ensuring your personal safety.
Our team will be available on call-during the Trip should you require emergency assistance. This does not extend to any medical or other costs that may arise from your circumstances through no act or omission on our part. Aside from emergency assistance, we will endeavour to respond promptly to you outside of scheduled activities.
Promotional materials
MIIRA takes pride in showcasing our Trips and experiences including guests in ongoing promotion of our business. Throughout the Trip, our Trip hosts, guides and facilitators may take photographs and video including guests which may be posted on social media, our website, and in promotional material in association with our business generally. Should you wish to be excluded from such material, you may advise us in writing (at any point prior, during or after the Trip). You will otherwise be taken, by confirmation of your booking, to consent to appearing and featuring in such content in the manner and for the purposes described above.
Limitation of liability
We will not be responsible liable for any injury, illness, death, loss, damage, expense, cost or other claim of any description resulting or in any way arising from:
(a) your breach of these Terms;
(b) your acts and/or omissions, whether or not negligent to any degree;
(c) the acts and/or omissions of any third party outside our control; or
(d) any event or circumstance beyond our reasonable control that prevents, delays, or materially affects the performance of its obligations, including but not limited to acts of God, natural disasters, extreme weather, fire, flood, earthquake, war, terrorism, civil unrest, strikes or labour disputes, government actions or travel restrictions, pandemics or public health emergencies, transportation disruptions, or failure of utilities or communications networks.
To the extent MIIRA is liable to you under these Terms or otherwise at law, our liability is limited to the amount equivalent to the excess on your insurance policy and if for any reason that is unenforceable then our liability is limited to the amount of the booking fee in respect of the Trip.
Changes to these Terms
We may amend these Terms from time to time in our discretion. Amendments shall become immediately effective upon publication on our Website. By continuing to use the Website or Services, you accept these Terms as they apply from time to time.
